The main tasks and activity directions of the Authorized Person for the Protection of the Rights of Entrepreneurs

 

The main tasks and activities directions of the Commissioner for the Protection of the Rights of Entrepreneurs are:

·                    participation in the design and implementation of state policy in the field of entrepreneurship development, protection of rights and legitimate interests of business entities;

·                    oversight over observance by state bodies of rights and legitimate interests of business entities;

·                    providing legal support to business entities when their activities inspections are carried out;

·                    coordination of inspections of the activities of business entities and control of the legality of inspections of the activities of business entities by regulatory authorities;

·                    the study of practical implementation of the norms and requirements of legislation on guarantees of freedom of entrepreneurial activity;

·                    assessment of the effectiveness of the impact of the adopted regulatory and legal acts on the implementation of entrepreneurial activities;

·                    preparation of proposals for improving legislation aimed at strengthening legal guarantees for business entities, stimulating their development.

 

Rights of the Commissioner for the Protection of the Rights of Entrepreneurs

The Commissioner for the Protection of the Rights of Entrepreneurs to perform the tasks assigned to him has the rights:

·                    to study the strict implementation of the legislation on observance of the rights and legitimate interests of business entities by state bodies;

·                    to monitor the legality of inspections of business entities, to make proposals for the adoption of comprehensive measures to prevent the facts of illegal interference in the activities of business entities;

·                    in writing, to declare to officials of state bodies and other organizations warnings about the inadmissibility of violation of legislation on observance of rights and legal interests of business entities;

·                    to submit to the heads of state bodies and other organizations submissions on the elimination of revealed violations of the law, the causes and conditions conducive to them, binding on schedule;

·                    to apply to the courts with statements, claims and complaints in the interests of business entities without paying a state fee;

·                    to request and receive from state bodies and organizations statistical, analytical materials, opinions and other information on the issues within its competence; to participate in meetings of state bodies related to the consideration of issues of protection of rights and legitimate interests of business entities;

·                    to participate in meetings of state bodies concerning consideration of issues of protection of rights and legitimate interests of business entities;

·                    to attract, if necessary, managers and specialists of state bodies, scientific institutions and other organizations, to create working groups to carry out the tasks assigned to them;

·                    freely visit places of detention, penal institutions to meet with representatives of business entities - suspects, accused and convicted of crimes in the field of entrepreneurial activity.

·                    drawing up of reports on administrative offenses in case of violation of the legislation that entails administrative liability.

 

The Commissioner for the Protection of the Rights of Entrepreneurs may also have other rights in accordance with the law.
